Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the prospiq platform at prospiq.net, a product of Pathweavers LLP. This policy is incorporated into our Terms of Service. Violations may result in account suspension or termination.

1. Permitted Use

prospiq is designed for legitimate B2B prospecting and professional outreach. You may use the Service to:

  • Find work email addresses and phone numbers for business contacts
  • Enrich your CRM or sales pipeline with verified email and phone data
  • Conduct bulk enrichment of prospect lists for B2B outreach
  • Research companies and their employees for professional purposes

2. Prohibited Activities

You may not use the Service for any of the following:

Spam and Unsolicited Communication

  • Sending unsolicited bulk email (spam) using enrichment results
  • Sending messages that violate CAN-SPAM, GDPR, DPDP Act, CASL, PECR, or any other anti-spam or privacy law
  • Using results for cold outreach without providing a clear opt-out mechanism
  • Adding contacts to mailing lists without their consent where required by law

Harassment and Harm

  • Using the Service to harass, stalk, threaten, or intimidate any individual
  • Using the Service to collect personal information for malicious purposes
  • Targeting individuals based on race, gender, religion, sexual orientation, or any protected characteristic
  • Using results to facilitate phishing, social engineering, or identity theft

Data Misuse

  • Reselling, redistributing, or sublicensing enrichment results to third parties
  • Building a competing product or database using data obtained from prospiq
  • Scraping, crawling, or systematically downloading data from the Service
  • Combining prospiq data with other data sources to create consumer profiles or dossiers
  • Using results for consumer (B2C) marketing, political campaigns, or debt collection

Technical Abuse

  • Circumventing rate limits, credit controls, or other technical restrictions
  • Using automated tools, bots, or scripts to access the Service beyond provided APIs
  • Attempting to gain unauthorized access to our systems, databases, or other users' accounts
  • Reverse-engineering, decompiling, or disassembling any part of the Service
  • Interfering with the performance or availability of the Service
  • Sharing account credentials or API keys with unauthorized parties
  • Creating multiple accounts to abuse free credit offers

3. Compliance with Laws

You are responsible for ensuring that your use of enrichment results complies with all applicable laws and regulations in your jurisdiction, including but not limited to:

  • General Data Protection Regulation (GDPR) — European Union
  • Digital Personal Data Protection Act (DPDP Act) — India
  • CAN-SPAM Act — United States
  • CASL — Canada
  • Privacy and Electronic Communications Regulations (PECR) — United Kingdom
  • Any other applicable data protection or anti-spam legislation

prospiq provides data — how you use it is your responsibility. We are not liable for your failure to comply with applicable laws when using our results.

4. Rate Limits and Fair Use

To ensure fair access for all users, we enforce rate limits on API calls and enrichment requests. These limits vary by plan and are documented in our API documentation. Consistently exceeding these limits or attempting to circumvent them is a violation of this policy.

5. Reporting Violations

If you become aware of any misuse of the Service or violations of this policy, please report it to us at support@prospiq.net. We take all reports seriously and will investigate promptly.

6. Enforcement

Violations of this policy may result in:

  • A warning and request to cease the violating activity
  • Temporary suspension of your account
  • Permanent termination of your account without refund
  • Reporting to appropriate law enforcement authorities in severe cases

We reserve the right to take any action we deem necessary to protect the Service, our users, and the individuals whose data is processed through the platform.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes are posted constitutes acceptance of the updated policy.
